Subscription Program and End User License Agreement

This Subscription Program and End User License Agreement, together with the Privacy Policy and any applicable order form, governs access to ChartMyBehavior, including the website, software, hosted services, templates, reports, AI-assisted drafting tools, and related support materials.

By creating an account, signing in, accepting an invitation, purchasing a subscription, or using the service, you agree to this Agreement. If you use the service for a school, district, clinic, agency, or other organization, you represent that you are authorized to use the service and provide student or client information for the educational or behavior-support purposes described here.

During an active subscription or authorized trial, ChartMyBehavior grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for non-commercial educational, clinical support, behavior data collection, reinforcement, progress monitoring, reporting, and team collaboration purposes.

You may use downloadable templates, exports, reports, and print materials generated by the service with the students, clients, classrooms, teams, or organizations you are authorized to support. You may not redistribute the software, sell generated templates as a competing product, or separate service components for use outside the service except as expressly allowed by the interface.

Each user must maintain accurate account information, keep credentials confidential, and use only accounts they are authorized to use. Shared passwords are not permitted.

Administrators and account owners are responsible for inviting only authorized teachers, BCBAs, RBTs, paraprofessionals, caregivers, supervisors, and other team members and for assigning the minimum level of access needed for their role.

As between ChartMyBehavior and the customer, student records, behavior observations, support plans, reinforcement events, assessment notes, and uploaded or entered educational records remain customer data. ChartMyBehavior does not claim ownership of customer data.

You grant ChartMyBehavior permission to host, process, transmit, back up, display, analyze, and export customer data only as needed to provide, secure, support, troubleshoot, improve, and comply with legal obligations for the service.

ChartMyBehavior may use aggregated or de-identified data to understand service performance, improve product quality, and produce non-identifying usage insights. Aggregated or de-identified data must not identify a student, family, educator, school, clinic, district, or customer.

When the service is used by or for an educational agency or institution subject to FERPA, ChartMyBehavior is intended to operate as a service provider performing an institutional service or function under the direction of the school, district, or authorized customer.

Users are responsible for confirming that their school or district has approved the service where required, that use aligns with local policies and annual FERPA notices, and that student personally identifiable information is used only for legitimate educational interests and authorized behavior-support purposes.

ChartMyBehavior will not knowingly redisclose student education records except as directed by authorized users, required to provide the service, required by law, or described in the Privacy Policy.

ChartMyBehavior is primarily designed for educational and behavior-support workflows. Some customers may be covered entities or business associates under HIPAA depending on their setting and data use.

A customer that requires ChartMyBehavior to create, receive, maintain, or transmit protected health information must have an appropriate business associate agreement in place before using the service for PHI. This online Agreement is not a standalone BAA unless a separate written BAA is executed by the parties.

AI-assisted features may help draft support plans, operational definitions, summaries, templates, or recommendations. AI output is informational and must be reviewed by a qualified educator, clinician, BCBA, supervisor, or other responsible professional before use.

Do not enter more personally identifiable information than necessary into AI prompts. AI features must not be used as the sole basis for eligibility, diagnosis, discipline, placement, treatment, crisis response, or other high-stakes decisions.

You may not copy, modify, reverse engineer, sublicense, resell, scrape, disrupt, attack, or attempt unauthorized access to the service. You may not remove legal notices, bypass permissions, share credentials, upload malicious code, or use the service in violation of law or third-party rights.

You may not use the service to create advertising profiles for students, sell student data, or make unauthorized disclosures of education records, protected health information, or confidential support-plan information.

The service may include templates, forms, charts, prompts, icons, sounds, documentation, and other content. ChartMyBehavior or its licensors retain ownership of service content, except for customer data entered by users.

You may print, download, and use generated outputs for authorized educational or clinical-support purposes with the students, clients, teams, schools, or organizations you support.

The service connects to hosted systems to authenticate users, synchronize data, provide updates, secure sessions, process payments, deliver AI-assisted features, and generate reports. Standard technical information such as browser, device, log, error, and usage data may be processed for these purposes.

Usage information may be used to maintain security, improve reliability, understand feature adoption, troubleshoot support issues, and support subscription administration.

Users must protect confidential student, client, school, district, clinic, and team information accessed through the service. You may disclose such information only to authorized parties and only for lawful educational, treatment, supervision, reporting, or support purposes.

Feedback, suggestions, bug reports, and product ideas may be used by ChartMyBehavior without compensation or restriction, provided that customer data and confidential student information remain protected as described in this Agreement and the Privacy Policy.

Paid subscriptions renew according to the selected plan unless canceled as described during checkout or in account billing settings. Failure to pay may result in suspension or limitation of paid features.

ChartMyBehavior may suspend or terminate access for material breach, unauthorized use, security risk, non-payment, or legal requirement. Upon termination, your license ends and you must stop using the service. Data export, retention, deletion, and archival handling are governed by the Privacy Policy, applicable law, and any written customer agreement.

The service supports data collection, visualization, reinforcement, documentation, and planning. It does not replace professional judgment, direct observation, clinical supervision, school team decisions, legal advice, medical advice, crisis services, or individualized determinations required by law or policy.

Charts, AI drafts, summaries, and reports may contain errors or incomplete interpretations if the underlying data is inaccurate, incomplete, biased, or insufficient. Users are responsible for reviewing outputs before relying on them.

To the maximum extent permitted by law, ChartMyBehavior is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, service interruption, or damages arising from misuse of the service.

Some jurisdictions do not allow certain exclusions or limitations, so some provisions may not apply. Any liability limits should be reviewed in connection with applicable customer contracts and governing law.

ChartMyBehavior may update this Agreement from time to time. Material changes will be communicated through the service, by email, or by posting an updated version with a new effective date. Continued use after the effective date means you accept the updated terms.
